For Schools Participating in AMI Health Solutions’ Compulsory Swimming & Fitness Program

1. Introduction

This agreement ("Agreement") is entered into between AMI Health Solutions ("Company") and [School Name] ("School"). The School agrees to enroll all designated students in the AMI Swimming and Fitness Program, which forms part of the school curriculum.

2. Program Overview

• Lessons are conducted as part of the school’s official timetable.
• The program covers swimming, water safety, and fitness training as per AMI Health Solutions’ curriculum.
• The program runs from January to November, in alignment with the school calendar.

3. Fees & Payment

• The School pays a fixed fee for the program, irrespective of student attendance.
• Payment terms will be as per the agreed contract between AMI Health Solutions and the School.
• No refunds or adjustments are made for student absences.

4. Safety & Supervision

• All lessons are conducted by qualified and experienced coache/s.
• The student-to-coach ratio will be maintained according to industry safety standards.
• The School agrees to ensure appropriate teacher/school staff supervision during lessons as required.

5. Liability & Indemnity

• AMI Health Solutions will take all reasonable precautions to ensure a safe learning environment.
• The School agrees to indemnify AMI Health Solutions, its employees, and coaches against any claims arising from injury, loss, or damages sustained during lessons, except in cases of gross negligence.
• The School shall obtain parental consent for student participation and acknowledges that AMI Health Solutions is not liable for any unforeseen incidents beyond its reasonable control.

6. Parental Consent & Acknowledgment

• The School is responsible for informing parents/guardians about the compulsory nature of the program.
• While AMI Health Solutions does not require individual parent signatures, the School must ensure that parents are informed of the indemnity clause and agree to their child’s participation.
• If a parent wishes to opt out for medical or other valid reasons, the School will manage such requests internally and communicate them to AMI Health Solutions where necessary.

7. Photography & Marketing Consent

• AMI Health Solutions may capture images/videos during lessons for training and marketing purposes.
• The School may grant or deny permission for such usage on behalf of the students. If required, individual parental consent can be managed by the School.

8. Amendments & Termination

• Any modifications to this Agreement must be mutually agreed upon in writing.
• Termination of the program by the School requires 3 months or 1 term' written notice, as per the agreement.

9. Governing Law

This Agreement is governed by the laws of South Africa. Any disputes shall be resolved under the jurisdiction of South African courts.
