Terms and Conditions & Indemnity

AMI Health Solutions Swimming Program

1. Introduction

Welcome to the AMI Health Solutions Swimming Program (the “Program”). This Program is an integral part of the Plaasjapie Kleuter Kampus curriculum and is funded by the school.

Participation in the Program is subject to the terms and conditions set forth below, as well as AMI Health Solutions’ Privacy Policy and any additional policies or procedures that may be published from time to time (collectively, the “Agreement”).

By completing this form, parents/guardians acknowledge their child’s participation in the Program and accept the terms outlined below.

2. Program Duration and Schedule

The AMI Health Solutions Swimming Program runs annually or monthly until November/December, depending on the agreement with Plaasjapie Kleuter Kampus.
Lessons are 20 or 30 minutes in duration and take place once or twice per week, as arranged by the school.

3. Payment & Invoicing

The school funds the Program through a fixed contractual agreement with AMI Health Solutions.
Parents are not required to make individual payments for their child’s participation.
Invoices are issued directly to the school administration for payment.

4. Adverse Weather & Cold Days Policy

In the event of unfavorable weather conditions or cold temperatures, AMI Health Solutions will provide dry-land training as a substitute for in-pool lessons.
Dry-land training focuses on coordination, strength, endurance, and injury prevention to ensure continuous skill development.

5. Cancellation & Withdrawal Policy

Since the Program is compulsory as part of the school curriculum, withdrawal is only permitted under exceptional circumstances, such as medical conditions, as determined by Plaasjapie Kleuter Kampus.
If a parent wishes to request an exemption for their child due to medical or other reasons, the request must be submitted directly to the school administration for review.
Any changes to the school’s participation in the Program must be communicated in advance and agreed upon between Plaasjapie Kleuter Kampus and AMI Health Solutions.

6. Missed Lessons Policy

Since the Program is funded by the school on a fixed basis, missed lessons by individual students do not qualify for make-up sessions.
If a lesson is missed due to an AMI Health Solutions coach’s absence, the session may be rescheduled at the discretion of AMI Health Solutions.

7. Liability & Indemnification

To the fullest extent permitted by law, AMI Health Solutions, its employees, and coaches shall not be held liable for any injury, loss, or damage sustained during participation in the Program, except in cases of gross negligence.
By completing this form, parents/guardians agree to indemnify and hold harmless AMI Health Solutions, its employees, and Plaasjapie Kleuter Kampus against any claims arising from injuries, accidents, or incidents during lessons.
AMI Health Solutions maintains strict safety protocols, and all lessons are conducted by qualified and experienced coaches in accordance with industry standards.

8. Medical Emergencies & First Aid Consent

Parents/guardians acknowledge that in the event of an injury or medical emergency during a lesson, AMI Health Solutions coaches may administer basic first aid.
In case of a serious incident, every effort will be made to contact the school and the child’s emergency contact before seeking medical assistance.
The school is responsible for ensuring that any relevant medical conditions of students are communicated to AMI Health Solutions prior to participation.

9. Privacy & Data Protection

The collection, use, and protection of student information are governed by AMI Health Solutions’ Privacy Policy, which is incorporated into this Agreement.
Any personal data provided by the school or parents will only be used for program-related purposes and in compliance with data protection laws.

10. Photography & Media Consent (Optional)

AMI Health Solutions may capture photographs and videos during lessons for training, educational, and promotional purposes.
Parents/guardians may grant or deny permission for media use on behalf of their child.

11. Modifications to the Terms & Conditions

AMI Health Solutions reserves the right to modify these terms as needed. Any changes will be communicated to Plaasjapie Kleuter Kampus in advance.
Continued participation in the Program after modifications have been made constitutes acceptance of the updated terms.

12. Governing Law & Jurisdiction

This Agreement is governed by the laws of South Africa.
Any disputes shall be resolved under the jurisdiction of the appropriate South African courts.
